TERMS OF USE

Alumniclass.com, Inc. ("Alumniclass.com") provides websites (referred to herein both collectively and individually as the "Site") for the purpose of providing class alumni a safe environment in which to communicate, interact, and share information. The Site is independent of the school and school district and their websites. Any information that you provide on this Site is subject to the Terms of Use and Privacy Policy. By accessing and using the Site, you are agreeing to be bound by the following Terms of Use and Privacy Policy.

Note that the Terms of Use may be updated by Alumniclass.com when seen fit; the updates become effective immediately, and any updated version will be posted immediately to the Site. Thus, we encourage all members to read through the Terms of Use periodically, as some changes may have been made.

PURPOSE OF THE SITE

This site only acts as a medium for alumni to come together and share content. This site is not responsible for posting content, nor does it guarantee that any content will be posted on the site. All content on the site comes from site members. By accepting these terms, you acknowledge and understand that it is the responsibility of all members to post useful content and information on the site, and that any lack of information that you may be seeking is not the responsibility of Alumniclass.com. Your one-time support is non-refundable under these terms.

MEMBERSHIP AND ACCESS TO SITE

By accepting these terms of use and proceeding past the first page of the registration process you are agreeing that a profile membership will be created for you, and the registration information which you entered will be saved, and your name and basic information (excluding email address) will appear throughout the site as one of our members. You may at anytime cancel this membership, and remove your profile and information from the site by logging into the site, clicking "My profile", followed by "Account", and then using the membership cancellation option on that page.

This Site is intended solely for the use of alumni members for that school in which the member is active on. It is not intended for use by other parties for any other purpose including investigation or solicitation. The Site IS INTENDED FOR PERSONS OVER THE AGE OF 18. BY ACCESSING THE SITE YOU REPRESENT YOU ARE A MEMBER OF THE SCHOOL FOR THE APPROPRIATE SITE, AND OVER THE AGE OF 18. Any member found to be under 18 will have their account terminated, and their rights to future use taken away.

To access all of the features offered on Alumniclass.com, one must pay a one-time fee of $20. Click here to view a list of the features. However one is not required to pay a fee to register for the Site or access parts of the Site. Note that even if you have not paid for membership, you are still to abide by the Terms of Use while browsing Alumniclass.com in any manner.

By providing information, you are representing and warrant the information is true, complete and accurate. For safety and spam abuse, external e-mail addresses and website addresses are not allowed to be posted inside your profile.

Any member found abusing our system in any way will lose their membership privileges without refund. ANY UNAUTHORIZED USE, COPYING, REPRODUCTION, MODIFICATION, REPUBLISHING, UPLOADING, DOWNLOADING, POSTING, TRANSMITTING, DISTRIBUTING OR DUPLICATING OR ANY OTHER MISUSE OF ANY CONTENT OF THE SITE IS SUBJECT FOR REMOVAL AND TERMINATION OF MEMBERSHIP.

PLEASE NOTE: ONE MUST HAVE THE COPYRIGHTS TO ALL MATERIALS ONE ATTEMPTS TO POST ON THE SITE; IF DISCOVERED, ANY MATERIAL THAT HAS BEEN UPLOADED ILLEGALLY OR WITHOUT THE CONSENT OF THE COPYRIGHT OWNER WILL BE REMOVED IMMEDIATELY.

All text and photos will be reviewed before they are posted. No obscene, offensive or pornographic materials are allowed. Alumniclass.com in its sole discretion shall determine what material is obscene, offensive or pornographic and will, without warning, remove such material.

For military: Military pictures with guns might be allowed in your some photos based upon the discretion of the Site management.

Alumniclass.com will attempt to monitor all areas of the Site vigorously and strictly. However, we cannot guarantee complete accuracy in catching all offensive material. We will not be held liable should a member be offended by something posted, however we will be extremely mindful of any complaints, and will take any action needed immediately.

All information contained on the Site is the property of Alumniclass.com. No information from the Site, including graphics, logos, photos or other information may be used without the express written consent of Alumniclass.com

MEMBERSHIP REMOVAL

If you wish to remove yourself from the Site, you may contact the Site management, or log-in to your account and delete your profile at any time.

We reserve the right to revoke membership of any alumni who may abuse this Site in any way deemed wrong in the sole opinion of Alumniclass.com.

The one-time fee is non-refundable under Alumniclass.com's Terms of Use.

LIMITATION OF LIABILITY

YOUR USE OF THE SITE IS ENTIRELY AT YOUR SOLE RISK. ALUMNICLASS.COM SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES OR LOSSES (INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES), WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, WHICH YOU MAY INCUR IN CONNECTION WITH THE USE OF, OR INABILITY TO USE, THE SITE, EVIN IF ALUMNICLASS.COM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR LOSS.

DISCLAIMER OF WARRANTIES

ALL ALUMNICLASS.COM WEBSITES ARE PROVIDED FOR YOUR USE ON AN "AS IS" BASIS. ALUMNICLASS.COM MAKES NO WARRANTY THAT THE INFORMATION ON THE SITE WILL BE ACCURATE, CURRENT OR RELIABLE OR THAT THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SITE WILL MEET YOUR EXPECTATIONS. ALUMNICLASS.COM DISCLAIMS ANY RESPONSIBILITY FOR THE DELETION, FAILURE TO STORE, MIS-DELIVERY, OR UNTIMELY DELIVERY OF ANY INFORMATION OR MATERIAL. YOU ASSUME THE ENTIRE RISK OF LOSS AND DAMAGE DUE TO YOUR USE OF THE SITE.

INDEMNIFICATION

You agree to indemnify, defend and hold Alumniclass.com and affiliates, business partners, employees and agents harmless from any loss, liability, claim, demand, damage, or expense (including reasonable legal fees) asserted by any third party relating in any way to your use of this website or breach of these Terms of Use. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, which shall not excuse your indemnity obligations.

CHOICE OF LAW AND VENUE

The Terms of Use, your access and the use of the Site and services and the relationship between you and Alumniclass.com is governed by the laws of the State of Washington, without giving effect to its conflict of law provisions. Alumniclass.com and you both agree to submit to the personal and exclusive jurisdiction of the courts of the State of Washington, County of Spokane. You are responsible for complying with local laws, if and to the extent local laws are applicable. Not-withstanding the foregoing, Alumniclass.com shall have the right to commence and prosecute any legal or equitable action or proceeding before any United States or non-United States court of competent jurisdiction to obtain injunctive or other relief in Alumniclass.com's sole discretion.
